Privacy Policy

Qerbia Solutions s.r.o., located at Severní 767/56, Slezské Předměstí, 500 03 Hradec Králové, Czech Republic, ID number 174 38 969, registered in the Commercial Register maintained by the Regional Court in Hradec Králové, Section C, Insert 49903, provides the Apexloop services. In order to provide these services to you, we process certain personal data.

We comply with the GDPR Regulation (EU Regulation 2016/679).

1. When We Process Your Data

A. When You Contact Us via the Form

We process your name, email, phone number, and any message you write to us so we can respond.

• Legal basis: Contract negotiation (Art. 6(1)(b) GDPR)
• Retention period: Max. 6 months from the last communication, unless further cooperation occurs

B. When You Make a Purchase

We use your billing information (name, address, contact details, purchase info) to process your order and fulfill legal obligations.

• Legal basis: Contract performance and legal obligations (Art. 6(1)(b) and (c) GDPR)
• Retention period: For the duration of service provision and 10 years afterward

C. When You Subscribe to Our Newsletter

We use your email to send you news and updates.

• Legal basis: Your consent (Art. 6(1)(a) GDPR), or legitimate interest if you're our customer (§ 7(3) of Act No. 480/2004 Coll.)
• Retention period: 2 years from consent or last purchase (you can unsubscribe anytime)

D. When You Consent to Cookies / Advertising

With your consent, we may use your email/phone for analytics and advertising (e.g., through Google tools).

• Legal basis: Consent (Art. 6(1)(a) GDPR)
• Retention period: Max. 1 year or until consent is withdrawn

2. Who Has Access to Your Data

Your data remains with us, but some of our partners may process it on our behalf – e.g., payment service providers, customer support, IT, and marketing providers. We have data processing agreements with all of them. These include:

• Payment processing companies (Comgate a.s., Fio Banka, a.s.)
• MS Clarity service provider – (Microsoft)
• Marketing and IT service providers

3. User Account

To create an account, we need your name, email, and other information you provide.

• Legal basis: Contract performance (Art. 6(1)(b) GDPR); other data is processed with your consent
• Retention period: As long as the account is used. If you don’t log in for more than 5 years (or 3 months for the Free version), we will delete the account. After deletion, we back up the data for another year.

4. Your Rights

You have the right to know what data we process, to request correction, deletion, restriction of processing, a copy of your data, or data portability. You can withdraw your consent or object to processing at any time.

If you believe we are mishandling your data, you may file a complaint with the Office for Personal Data Protection or take the matter to court.
